Overview
These Terms of Use (“Terms”) govern access to and use of the NexDrain Plumbing & Drain website. By using the website, you agree to these Terms. If you do not agree, do not use the website.
These Terms apply to the website and online request tools. Plumbing estimates, work authorizations, invoices, warranties, financing documents, or other service agreements may contain additional terms. If there is a conflict concerning actual plumbing work, the signed service document controls for that work.
Website purpose
The website provides general information about NexDrain, plumbing services, service areas, completed projects, customer feedback, and ways to request service. Content is provided for general informational and customer-service purposes.
Website information is not a plumbing diagnosis, engineering opinion, code determination, permit approval, utility instruction, or guarantee that a particular repair is appropriate for a property. Plumbing conditions vary, and recommendations may change after an on-site inspection, testing, access, or discovery of concealed conditions.
Emergencies and safety
Online forms, email, chat, and automated tools are not monitored as emergency-dispatch systems and do not guarantee an immediate response.
- For immediate danger, fire, injury, or threat to life, call 911.
- If you smell gas, leave the area without operating switches, using a flame, or taking other actions that could create a spark. Contact the gas utility or emergency services from a safe location.
- For active flooding, shut off water only if you can safely identify and reach the appropriate valve, then call NexDrain or emergency services as the situation requires.
- Follow instructions from utilities, public-safety agencies, property management, and local authorities.
Service requests and scheduling
Submitting a website form, email, photograph, telephone message, or AI-assistant message is a request for contact only. It does not:
- Guarantee an appointment, response time, price, technician, part, or service availability.
- Create a plumber-customer relationship or contract for plumbing work.
- Reserve a date or time until NexDrain confirms the appointment.
- Authorize NexDrain to enter a property or begin work.
You agree to provide accurate contact, property, and problem information and to promptly tell NexDrain if conditions materially change before the appointment.
Communications
When you submit a service request, you authorize NexDrain to contact you about that request using the telephone number, email address, or preferred contact method you provide. Communications may include appointment coordination, questions, estimates, service updates, and follow-up related to the request.
Standard telephone, text-message, or data charges imposed by your provider may apply. Providing contact information for a service request is not permission for unrelated mass marketing. You may ask NexDrain to stop nonessential promotional communications, while service-related and legally required messages may continue as appropriate.
Photos, messages, and other submissions
You may submit only information and content that you own or are authorized to provide. You must not upload or send:
- Payment-card information, Social Security numbers, government identification, passwords, access codes, or unrelated sensitive information.
- Content that is unlawful, threatening, deceptive, defamatory, infringing, malicious, or intended to damage the website.
- Photos or documents that violate another person’s privacy, intellectual-property rights, contractual duties, or legal rights.
- Malware, automated spam, or code intended to interfere with the website.
You retain ownership of your submitted content. You grant NexDrain a limited permission to receive, store, reproduce, review, and share it with authorized personnel and service providers as reasonably necessary to respond to the request, provide service, maintain records, and protect legal rights. NexDrain will not publish customer-submitted photos as marketing or project-gallery material without separate permission.
AI assistant
If available, the website’s AI assistant is an automated routing and information tool. It may misunderstand a message, provide incomplete general information, or be unavailable. It is not a licensed plumber, emergency responder, or substitute for an on-site diagnosis.
Do not rely on the assistant for gas, fire, flooding, electrical, structural, contamination, medical, or other safety-critical decisions. NexDrain may review assistant conversations for service routing, quality, security, and improvement. A message to the assistant does not guarantee that a human has reviewed or accepted the request.
Acceptable use
You agree not to misuse the website. Prohibited conduct includes attempting unauthorized access, bypassing security, overwhelming the site, scraping or copying content through automated means without permission, impersonating another person, submitting fraudulent requests, introducing malicious code, or using the website in violation of law.
NexDrain may restrict or block activity reasonably believed to threaten the website, its users, company operations, or legal rights.
Intellectual property
The website’s design, text, graphics, logos, photographs, project presentations, software, and other materials are owned by NexDrain, AtlasBlake Technologies, their licensors, or the identified rights holder and are protected by applicable intellectual-property laws.
You may view and print reasonable portions of the website for personal, noncommercial use related to evaluating or requesting NexDrain services. You may not copy, republish, sell, license, remove ownership notices from, or create a competing product from website materials without written permission.
Third-party names, marks, reviews, maps, and services remain the property of their respective owners. Their appearance does not transfer ownership or imply an endorsement beyond the context shown.
Third-party services and links
The website may use or link to hosting, maps, reviews, social networks, analytics, communications, scheduling, payment, utility, regulatory, or other third-party services. NexDrain does not control those services and is not responsible for their availability, content, security, terms, or privacy practices.
A link is provided for convenience and does not necessarily mean NexDrain endorses every statement, product, or service available through the linked website.
Website disclaimers and limitation of liability
The website is provided on an “as available” basis. NexDrain works to keep the information useful and accurate but does not guarantee that every page will be complete, current, uninterrupted, secure, or error-free. Service descriptions and availability may change.
To the fullest extent permitted by law, NexDrain and its website providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising solely from use of, inability to use, or reliance on the website. This limitation does not limit responsibility that cannot lawfully be excluded and does not replace the terms that govern plumbing work actually performed.
Your primary remedy for dissatisfaction with the website is to stop using it and contact NexDrain directly for clarification.
Governing law
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles, except where federal law controls. If any provision is found unenforceable, the remaining provisions remain in effect. A failure to enforce a provision is not a waiver of the right to enforce it later.
Changes to these Terms
NexDrain may update these Terms when website features, business practices, or legal requirements change. The current version will be posted on this page with a revised “Last updated” date. Continued use of the website after an update means the revised Terms apply to subsequent website use.
